Twenty-Fore-Seven Mobile Golf Co.
Participant Waiver & Release of Liability
PLEASE READ CAREFULLY BEFORE SIGNING.
In consideration of being granted access to and permitted to use the golf simulator operated by Twenty-Fore-Seven Mobile Golf Co. (“the Company”), including access during unattended periods, I acknowledge and agree to the following:
1. Assumption of Risk
I understand that participation involves swinging a golf club at high speed within a confined space, and that this activity carries inherent risks including, but not limited to: being struck by a golf club, ball, or equipment; contact with the simulator screen, netting, frame, walls, or projection equipment; slips, trips, and falls on flooring, steps, or surrounding areas; muscle strains, sprains, and other orthopedic injuries; and collision with other participants or bystanders. These risks may result in property damage, bodily injury, permanent disability, or death. I knowingly and voluntarily assume all such risks, whether known or unknown, and whether caused by the negligence of the Company or otherwise.
2. No On-Site Staff / Unattended Access
I understand the facility may be accessed and used at times when no staff, supervision, or medical personnel are present. I accept full responsibility for my own safety and conduct, and for that of any guest I bring, and I agree to use the facility only in accordance with posted rules and signage.
3. Release and Waiver
I hereby release, waive, and discharge the Company, its owners, officers, employees, agents, contractors, and the owner or operator of the premises, from any and all liability, claims, demands, actions, and causes of action arising out of any loss, damage, or injury, including death, that may be sustained by me or by any property belonging to me, whether caused by the negligence of the released parties or otherwise, while using the facility or while on or about the premises or equipment.
4. Indemnification
I agree to indemnify and hold harmless the released parties from any loss, liability, damage, or cost, including attorney fees, arising out of my use or my guests’ use of the facility, including any claim brought by a third party as a result of my or my guests’ actions.
5. Rules and Conduct
I agree to follow all posted rules, signage, and safety instructions, including those regarding swing-area boundaries, spectator positioning, equipment handling, and occupancy limits. I understand that the Company may suspend or terminate my access at any time for unsafe conduct or rule violations.
6. Alcohol and Impairment
I represent that I am not under the influence of alcohol, drugs, or any impairing substance, and that I will not enter or use the facility while impaired. I acknowledge the Company’s no-alcohol policy: I will not bring, consume, or permit alcohol on the premises, and I understand that doing so is a violation of my membership that may result in immediate termination of access, unless posted otherwise at the event that the venue provides alcohol.
7. Physical Condition
I represent that I am in good physical health and have no medical condition that would prevent safe participation. I understand that no medical personnel are on site, and that in an emergency I am responsible for calling 911 using the facility address posted on the premises.
8. Video Surveillance
I understand the premises are monitored and recorded by video, and I consent to such recording as a condition of access.
9. Guests
I am responsible for any guest I bring. Each guest must be registered and must sign this waiver before entry, and I am responsible for my guests’ compliance and conduct.
10. Participants Under 18
If the participant is under 18 years of age, I represent that I am the parent or legal guardian, that I have read and agree to this document on the minor’s behalf, and that I release the parties above with respect to any claim arising from the minor’s participation, to the fullest extent permitted by law.
11. Media Release
I grant the Company permission to use photographs, video, and swing data captured during the activity for promotional purposes, without compensation. Written notice will be provided to Company if I do not consent.
12. Governing Law and Severability
This agreement is governed by the laws of the State of Ohio. If any provision is found unenforceable, the remaining provisions remain in full force and effect.
13. Acknowledgment.
I have read this document in full. I understand that I am giving up substantial legal rights, including the right to sue. I sign it freely and voluntarily, without inducement
